OCSS has the legal authority to place liens on real and personal property (i.e. homes and vehicles) when the following criteria is met:
When property is discovered, and it is appropriate to place a lien, OCSS will complete the necessary paperwork and notify the County Recorder’s Office and/or the County Auto Title Division. The parent receiving child support payments will also receive a confirmation letter advising a lien has been placed.
In order to have the lien removed on the property, all arrears on the order must be paid in full.
Liens may be placed on property that has dual ownership.
- Case is in default
- The parent who is paying child support is not currently in bankruptcy proceedings
- The order is at least three (3) months behind in support
- There is not an active Income Withholding in place
